Effective Date: October 2026
Please review these Terms and Conditions carefully before utilizing our services, scheduling appointments, or acquiring carpets from Premium Rugs. By engaging our consultation services, submitting orders, or commissioning carpet repairs, you agree to be bound by the terms outlined below.
1. General Overview & Company Identification
- Trade Name: Premium Rugs
- Physical Location: 29 Trent Place, Westville, Durban, KwaZulu-Natal, 3629
- Direct Telephone / WhatsApp: +27 72 215 2526
- Email: ufvania@gmail.com
These terms apply to all visitors, clients, and trade partners across the Republic of South Africa and are governed in accordance with the laws of South Africa, including the Consumer Protection Act (CPA) and the Protection of Personal Information Act (POPIA).
2. Nature of Inventory & Authenticity
- Hand-Knotted Variance: Every classical Persian carpet (such as Kashan, Nain, Isfahan, or Tabriz) and hand-loomed flat-weave Kilim is uniquely constructed using natural wool, vegetable dyes, or fine silk. Slight irregularities in weaving patterns, natural color striations (abrash), and marginal dimensional variances are characteristic hallmarks of authentic artisanal goods, not manufacturing defects.
- Modern Designer Carpets: Modern and abstract collections comply with specified fiber compositions (including wool, viscose, or bamboo silk blends) detailed at the time of quotation.
- Photography & Representation: While we make every effort to display high-resolution imagery and accurate color profiles, ambient home lighting, sunlight angles, and personal monitor settings may result in minor visual differences in your space.
3. Inquiries, Quotations & Payment
- Quotations: Formal written quotes, invoices, and service estimates issued via WhatsApp or email remain valid for 14 calendar days from the issue date, subject to stock availability.
- Payment Terms: Full payment via verified electronic funds transfer (EFT) or agreed payment facilities is required prior to the dispatch, delivery, or handover of any rug.
- Title of Goods: Full ownership and legal title of all items remain with Premium Rugs until receipt of cleared funds in full.
4. Consultations & In-Home Trials
- Trial Bookings: We offer selective in-home viewings and trial placements within the greater Durban, Umhlanga, Ballito, and Pietermaritzburg metropolitan areas by prior appointment.
- Client Duty of Care: During on-site trials, clients are responsible for providing a clean, safe environment free of active construction, liquid hazards, and pets. If a rug suffers liquid damage, soilage, or pet contamination during an in-home trial, the client agrees to bear the full cleaning or restoration costs, or purchase the item at the agreed showroom rate.
5. Cleaning, Repair & Restoration Terms
- Pre-Service Inspection: Every carpet accepted for deep-immersion hand-washing, structural repair, fringe replacement, or selvedge binding undergoes a pre-service inspection to note pre-existing rot, yarn brittleness, wear patterns, or fiber instability.
- Inherent Risks in Aged Textiles: While we utilize conservative, heritage-safe wash formulas and skilled hand-restoration techniques, Premium Rugs cannot be held liable for the separation of previously deteriorated warps, pre-existing fugitive dye bleeding caused by prior domestic chemical treatments, or structural breakdown in fibers with severe dry rot.
- Uncollected Goods: Once notified that restoration or cleaning work is finalized, clients must collect or arrange delivery within 30 calendar days. Goods remaining uncollected after 60 calendar days without written arrangement may incur storage fees of R50 per day or be disposed of in accordance with legal debt recovery processes.
6. Certified Insurance & Estate Valuations
- Scope of Appraisal: Written valuation certificates reflect market replacement values, verified knot density, age estimates, and regional origin based on expert appraisal at the date of inspection.
- Liability Limitation: Valuations represent professional opinion based on current market trends and South African insurance underwriter standards; they do not constitute an open guarantee or buy-back offer from Premium Rugs.
7. Delivery, Logistics & Risk
- Delivery Arrangements: Local delivery within Durban and courier transport across South Africa are coordinated using insured, tracked third-party courier services.
- Risk of Loss: Risk transfers to the client once the goods are signed for at the designated delivery address. The recipient must inspect the packaging upon receipt and report any transit damage immediately.
8. Dispute Resolution & Jurisdiction
Any disputes arising out of or related to these Terms and Conditions shall be resolved amicably through direct good-faith communication. Where resolution cannot be achieved, matters will fall under the jurisdiction of the Magistrate’s Court of Durban, KwaZulu-Natal.
